dc.description.abstract | The enactment of Law Number 7 of 2017 on General Election has created some controversies. One of those controversies is about Presidential Threshold, whether it is still needed while the upcoming Presidential Election and Legislative Election General Election in 2019 will be held simultaneously. This research is normative legal research with statute and comparative approaches. The result of this study shows that the Presidential Threshold in the upcoming simultaneous election in 2019 still has some problems. Firstly, the new political parties cannot propose their president and vice president to contest in the general election 2019 because of the minimum standard of presidential threshold is came from the result of Legislative Election 2014. Secondly, the presidential threshold violates the Article 6A Paragraph 2 of the 1945 Constitution. Thirdly, the percentage of presidential threshold is too high and the political party should form the coalition to reach that percentage. This research proposes some recommendations. First, presidential threshold needs deep evaluation regarding the percentage requirements of the President and Vice President candidacy. Second, the Election Mechanism should be transparent and open to public. Third, the Presidential Threshold should in line with the provision of the 1945 Constitution. | en_US |
